Attorney Ronald LaRocca successfully persuaded the Rhode Island Supreme Court to uphold the Superior Court's decision in favor of LSG's client (a seller of real estate) due to the buyer's breach of a real estate purchase and sales agreement. Attorney LaRocca argued that the buyer's refusal to close in a timely manner constituted a breach of contract, despite the lack of a "time is of the essence" provision in the agreement. To combat the buyer's arguments, Attorney LaRocca focused the Supreme Court's attention on the course of dealing between the parties and the buyer's lack of any valid basis to timely close on the property. The Supreme Court's holding clears the title to LSG's client's property so that it may be sold and it also allows LSG to pursue money damages against the defaulting buyer.
